b'Your Constitutional RightsBy Randy MillerDirector of the Constitutional Sheriffsand Peace Officers Association forArizona, 623-866-3544.To learn more about our constitutionsand your rights, contactme at Supremelawoftheland.comL ast month I tried to emphasize that those who rebel against the Constitution shall not serve in office, per the Constitution. In past articles, it was that government spends nearly entirely outside its constitutional authorities, so why pay taxes? Ive written about the states having authority over immigration, not the federal government, despite what SCOTUS has ruled. The courts bring up another topic. Their rulings are in many cases ridiculous but based on the times, which shows their propensity to play politics as all humans do. Recently, SCOTUS decided their 40-plus year decision, Roe vs Wade, was unconstitutional and a state right. Gee, it took putting conservative appointments on the bench to do this. How political is that? This isnt what the court is for but it happens all too frequently. During COVID, it was brought up by Justice Sotomayor that there were over 100,000 children in serious condition or on ventilators and how we never had this before. This wasnt close to being true, but was in her mind, a basis for what she wanted to do, not the Constitution, but an emotional opinion based on a lie. This was rebelling against the Constitution and clearly in violation of any application of it she must apply. So, should she be removed for bad behavior? This is a condition of her serving under Article 3 of the Constitution. Or, is this a criterion for the 14th Amendment Clause 3? How about other justices that fail this test? Where are the congressional members calling for impeachment? This is an example in my opinion, of the damages caused by ignorance of the Constitution by those in office, political agendas, or cowardice. If there were frequent public cries from elected representatives, on specific violations, not ambiguous claims frequently made, then maybe we would have more controls on the actions and statements made. Instead, we have 536 political animals from various parties, some Communist Democrat Party of America and Socialist Democrats and others that are just plain communists, these legally ineligible to serve based on their ideology, all fighting for their party ideologies, not the Constitution, which is the law. Their political beliefs are antithetic to our Constitution, which means they cannot serve based on no intention of upholding and defending the Constitution if federal, or supporting the Constitution of the United States and of Arizona if state legislators or lower. This includes the Republican Party. I say this because members frequently propose (sponsor) unconstitutional legislation or vote for it. Just a distant example with many more recently, are the 2005 passage of the Patriot Act, and also the creation of the TSA, Homeland Security, and the Travel ID, all unconstitutional, but a gift from the Republican-controlled House, Senate, and President Bush. Today, we are still dealing with the aftermath of everything being related to COVID as unconstitutional. All the economic damage done to the middle class with the belief by those in government that they have the ability to declare a state of emergency thus granting more illegal executive orders or law-making authority to the president. This is a violation of the separation of powers where Congress is the only body granted the authority to make law. But that wasnt enough, the CDC had to get in the game, they are unelected bureaucrats, not granted authority over anything but making recommendations. Yet, it was this agency that forbid landlords from evicting tenants failing to pay their rent. This is a taking of your property in violation of the 5th Amendment that says you shall not be deprived of life, liberty, or property, without due process. The case was accepted by SCOTUS, but they didnt rule because it was due to expire soon and that made it moot. This failed to address the issue, which in my opinion was the idea. Now both republicans and democrats believe they have the authority to make law on our Bill of Rights, their favorite to assault is the Second Amendment. The Preamble to the Bill of Rights specifically explains that Congress is restricted from making any laws that impact them. Would you say this is rebelling against the Constitution and their oath of office? I certainly do. It is past time we all become more active and take time to attend our legislative district meetings, give our legislators a piece of our minds and replace them with new ones. I find it hard-pressed to find justification for keeping any of them. None of them did their job during COVID, none. Please contact me for information on how you can get involved and attend our Constitution groups in Wickenburg, Buckeye, or Phoenix area.
