b"Jews continued from page 21Settling down in Tucson, Levy was at ease gambling in the Fashion Hotel on the evening of June 5, 1882, when he ran afoul of the faro dealer, a man by the name of Johnny Murphy. As in the case of the incident with Harrison, the two men verbally insulted each other, the insults escalating, but since Levy was not carrying a gun, there initially was no gunplay. But the cowardly Murphy was still taking no chances. He knew of Levy's reputation, he knew he couldn't directly face him face-to-face in a gunfight, so, enlisting two local thugs named Dave Gibson and Bill Palace Hotel, Tucson Moyer, he went to the front of Tucson's Palace Hotel where Levy was staying and set up an ambush. As Levy walked out the doors of the hotel, still unarmed, the three men sprung out of the shadows and opened fire on the doomed Levy - at least one account suggesting that the three cowards shot Levy in the back.As was so typical of Old West justice - NOT - at the time, Murphy and Dave Gibson were acquitted even though the evidence clearly showed that they had murdered - from ambush - an unarmed man. Only Moyer, for reasons not known, was given a life sentence for his role in the cold-blooded murder of Jim Levy.Who knows what might have happened if Jim Levy had lived on to a ripe old age? Would he have become as famous as Wyatt or Bat, or still faded into obscurity?
